Disclaimer & Terms of Use

Effective Date: October 22, 2026

Welcome to Molding Process Solutions ("MPS," "we," "our," or "us"). By accessing or using this website, you acknowledge that you have read and understood this Disclaimer and Terms of Use. If you do not agree, please stop using the website.

1. General Information

The information on this website is provided for general informational purposes only. We aim to keep it accurate and current, but we make no representations or warranties, express or implied, about its accuracy, completeness, reliability or availability. Any reliance you place on it is at your own risk.

2. Engineering, Simulation and Consulting Services

MPS provides consulting services in injection molding process optimization, Moldflow® simulation, computer-aided engineering (CAE), manufacturing analysis, design reviews, process troubleshooting and related technical training.

All simulations, calculations, reports, recommendations and assessments are based on assumptions, customer-provided information, material data, software models and boundary conditions available when the work is done. Simulation is a predictive tool only. Actual results can differ, for example because of:

  • material and lot variations, moisture content
  • processing conditions, machine condition, tool wear, mold tolerances
  • environmental factors and operator practice
  • inaccurate or incomplete input data
  • limits of the software and material databases

Nothing we provide is a guarantee of product performance, manufacturability, production outcome, quality, regulatory compliance, commercial success, cost reduction or cycle time reduction. Customers are responsible for validating all recommendations through testing, prototyping, process validation and production trials before implementation.

3. No Professional Engineering Certification

Unless a signed written agreement says otherwise, our services are not licensed Professional Engineer (PE) services, engineering certification, regulatory approval, product certification, compliance certification or legal advice. Final engineering, production release, regulatory and business decisions remain with the customer.

4. Customer Responsibility

Customers remain responsible for product design and safety, material selection, tool design and approval, manufacturing processes, qualification and validation, regulatory and standards compliance, quality systems, specifications and commercial decisions. Implementing any recommendation is at the customer's own risk.

5. No Warranty

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEBSITE CONTENT, REPORTS, ANALYSES, TRAINING MATERIALS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." MPS DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY AND ERROR-FREE OPERATION. No oral or written statement creates a warranty unless it is in a signed written agreement.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MPS IS NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES, LOST PROFITS OR REVENUE, LOST BUSINESS OPPORTUNITIES, PRODUCT RECALLS, TOOL MODIFICATION COSTS, DOWNTIME, PRODUCTION DELAYS, SCRAP OR REWORK COSTS, LOSS OF GOODWILL OR LOSS OF DATA, WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, WARRANTY, STATUTE OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7. Maximum Liability

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to our services is limited to the fees actually paid by the customer for the specific services giving rise to the claim, regardless of the number of claims.

8. Reports and Third-Party Reliance

Reports, simulation studies, assessments, presentations, calculations and recommendations are for the named client only. Unless agreed in writing, third parties may not rely on them, distribution does not create any duty of care, and anyone who relies on them does so at their own risk. Reports are engineering estimates based on information available at the time and are not guarantees of future performance. These limits apply whether or not this Disclaimer is repeated in the individual document.

9. Third-Party Software and Data

We use software, databases and technology from third parties. We make no representation or warranty about Moldflow® software output, material databases, finite element or fluid dynamics tools, optimization software, third-party updates or defects, or third-party data. All simulation software has limitations and assumptions that can affect results.

Moldflow is a registered trademark of Autodesk, Inc. and/or its subsidiaries. MPS is an independent company and is not affiliated with, endorsed or sponsored by Autodesk.

10. Intellectual Property

All website content, including text, graphics, logos, technical documents, reports, training materials, methods and workflows, is protected by applicable intellectual property laws. Nothing may be copied, distributed, modified, published or used without our prior written permission.

11. Confidential Information

Sending information through this website or the contact form does not by itself create a confidential relationship. Please do not send CAD files or other confidential data through the website. Confidential treatment of information is governed by a signed Non-Disclosure Agreement, Master Services Agreement or similar written contract, which we are glad to sign before we receive any project data.

12. Indemnification

Any indemnification obligations between MPS and a customer are set out in the signed written agreement for the services. Visiting this website does not create any indemnification obligation.

13. Export Control and Sanctions

Users and customers must comply with all applicable export control laws, sanctions and trade restrictions of the United States, the European Union, the United Kingdom and any other applicable jurisdiction. Our services may not be used in violation of them.

14. External Links

This website may link to third-party websites. We have no control over and accept no responsibility for their content, security, accuracy, availability or privacy practices. A link does not imply endorsement.

15. Website Availability

We do not guarantee uninterrupted access to this website. Access may be interrupted by maintenance, updates, technical failures, security incidents, force majeure or other circumstances beyond our reasonable control.

16. Additional Contractual Documents

Engagement of our services may also be governed by additional documents, such as a Master Services Agreement, Statement of Work, Non-Disclosure Agreement, proposal or quotation, service or training agreement, and project contract. If a signed written agreement exists, its terms prevail over this Disclaimer for the services it covers. Nothing on this website creates a contract unless both parties expressly agree in writing through authorized representatives.

17. Acceptance of Risk

Engineering analysis, computer simulation, process optimization and consulting involve predictive methods and inherent uncertainty. The customer accepts the risks of implementing recommendations, and final engineering, manufacturing, quality, regulatory and commercial decisions remain the customer's responsibility.

18. Severability and Entire Agreement

If any provision of this Disclaimer is found invalid, unlawful or unenforceable, the other provisions remain in full force. This Disclaimer, together with any signed written agreement, is the whole understanding about use of this website and replaces earlier statements about it.

19. Governing Law and Jurisdiction

This Disclaimer is governed by the laws of the State of Oregon, United States, without regard to conflict-of-law principles. Where customers in the European Union, United Kingdom or other jurisdictions have mandatory consumer rights, nothing here limits rights that cannot legally be waived. Any dispute not subject to mandatory local jurisdiction is decided exclusively in the state or federal courts located in Oregon.
